DECLUTTER WITH KIAH

Client Agreement, Waiver and Release of Liability

By signing this Agreement, I acknowledge and agree to the following terms and conditions:

Donations

I authorise Declutter with Kiah to donate any items that I have approved for donation to a second-hand shop, charity, or donation centre. Once these items have left my property, I understand and agree that Declutter with Kiah is not responsible for tracking, recovering, or investigating the whereabouts of those items.

Loss or Damage to Property

I understand that Declutter with Kiah provides organising, decluttering, Feng Shui and related services only. Declutter with Kiah is not responsible for any loss, advice, damage, or breakage of items that occurs during the sessions.

I acknowledge that Declutter with Kiah cannot guarantee the condition or location of any item after it has been handled, moved, transported, or stored.

Personal Property

I understand that it is my responsibility to identify and secure valuable, sentimental, confidential, or irreplaceable items before any decluttering, organising, packing, unpacking, cleaning, or sorting session. Declutter with Kiah will not be liable for items that become misplaced or lost during or after a session.

Client Safety

I acknowledge that I participate in decluttering, organising, Feng Shui and related activities at my own risk. I release and discharge Declutter with Kiah from any liability for injury, loss, damage, or expense that I may suffer during or after these activities, except where liability cannot legally be excluded.

Service Provider Safety

I understand that Declutter with Kiah reserves the right to refuse any task that may pose a risk to health or safety, including but not limited to climbing ladders, handling hazardous materials, or undertaking unsafe lifting or moving activities.

Payment Terms

Full payment for services is due within seven (7) days of the service date unless otherwise agreed in writing.

Cancellation Policy

If a booking is cancelled on the same day as the scheduled appointment, Declutter with Kiah reserves the right to charge a cancellation fee of up to 100% of the booked service fee.

Refund Policy

Subject to any rights that cannot be excluded under Australian Consumer Law, fees paid for services are non-refundable.

Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, representations, understandings, and agreements relating to the services provided by Declutter with Kiah.

No amendment, modification, or waiver of any provision of this Agreement shall be effective unless made in writing and signed by both parties.

Continuing Effect

The provisions of this Agreement shall remain in full force and effect following the completion or termination of services provided by Declutter with Kiah.

Acknowledgement

I confirm that I have read and understood this Agreement and have had the opportunity to seek independent advice before signing. I acknowledge that I am signing this Agreement freely and voluntarily and that I intend to be legally bound by its terms.
